There are two basic legal mechanisms available to the victims of domestic violence and spousal abuse: you can file criminal charges or you can seek civil remedies.
- If you decide to file criminal charges, they will be filed with the Ohio prosecutor's office. You will have to act as the primary witness in the state's case against your abuser. While the case is pending, you can obtain a restraining order from the court. The restraining order will only last until the case is resolved, unless you take action to renew it.
- If you choose to pursue civil action, you may obtain a civil protection order that could last for up to five years. If the abuser violates the order, he or she could be sent to jail. You may also obtain use of the primary residence, even if it is in the name of the abuser. You may also receive temporary child custody, alimony, child support, and the use of a vehicle.
